TRAVEL AGREEMENT
We are Batan Houseboat, and we look forward to the opportunity to act as your travel service provider at Tanguar Haor. These terms and conditions (the “Agreement”) describe what you are legally entitled to expect from us when you purchase any travel-related services through us, in addition to your obligations as a customer. The terms “we”, “us”, and “our” refer to Batan Houseboat. The term “you”, “representative” refers to the customer
1. Agreement
A. Service and Service Provider
You have to pay the additional charge if the government or any responsible authority increases the cost of any goods or services after your booking. This means that after the agreement, the ‘Batan Authority’ would not bear any type of service charge increase by the government or related authorities for any kind of uneven situation. By signing this agreement, you sincerely consent to post-purchase price increases and the payment thereof.
B. Collateral or Payment
Each kind of collateral is nonrefundable.
Paying a security deposit only establishes your prior right to purchase the product or service and does not indicate that the product or service has ever been purchased or that the price will remain unchanged at the time of purchase.
Only full payment of the bill or amount due by the specified date and the issuance of the necessary documents ensure the availability of the good or service. The full package price must be paid at least three days before the start of the journey. Otherwise, we reserve the right to sell the same product or service to someone else.
C. Documentation
We usually provide electronic copies of all documents. An additional fee will be charged for sending the printed copies to your address. Travelers may be required to show an original copy of their passport, national identity card, birth certificate, institutional identity card, or marriage certificate, as applicable, or provide a photocopy, as applicable, as proof of identity.
D. Modification and Cancellation
By entering into this agreement, you grant us the right to make any changes to the booking or cancel the booking. After confirming a booking, if there is any change in the booking plan due to political, natural, or other reasons, we will try to inform you by e-mail or phone as soon as possible.
In that case, you may get an opportunity to modify the booking plan, or cancel the booking as per Batan Houseboat policy. The e-mail and phone number provided in favor of Bataan Houseboat should be checked regularly before or during the trip to maintain communication. As the authority of Batan is not liable for natural and political occurrences, you have to pay for any price or cost increases resulting from these occurrences.
E. Refund Policy
You may be eligible for a refund policy in the following situations:
- Only reservations that are dropped 10 days or more before the trip will be eligible under the return policy.
- In the case of bookings canceled 10 days or earlier, 50% of the entire travel package and 3% of the cancellation fee will be charged, and the rest of the amount will be refunded.
- If the trip cannot be completed due to political, natural, or any other reason after the start of the journey, it will not be eligible under the refund policy.
- Even if we are unable to start the journey on time due to any of the unforeseen reasons mentioned above, it will not be eligible under the refund policy. In that case, you have to make an alternative or modified plan.
Your Agreement with Us
Consent to the following terms:
By completing the booking in accordance with our policies, you and those you represent agree to all of the terms and conditions enumerated in Sections 1 through 3 of this agreement, as well as the issue of community contributions. You also agree that in the event of any violation of you or anyone else’s terms, we may take any legal action:
By booking with us, you agree to the following terms and conditions in any case of violation of the Batan Houseboat policies:
- Cancellation of your booking;
- Cancellation of any deposited guarantee or paid amount;
- Refraining from accepting any goods or services related to the travel;
- Charging for the amount of damage incurred as a result of breaching the conditions;
- Acceptance of necessary legal measures.
You also provide further assurance that:
- You are of legal age to use our services.
- You have the legal authority to represent those on whose behalf you are entering into the agreement.
- All information provided by you and your team members is true and accurate. Besides, you are responsible for including all other team members in this agreement and informing them about other conditions. Any charges resulting from the use of the service by you or any member of your team will be charged to the account provided by you at the time of booking.”
If you Change the Booking
If you request any changes to the booking plan, if feasible, you will be required to pay the designated service fee and any additional charges imposed by the service provider.
Participation in the event or booking transfer is only allowed with our permission; otherwise, it will be null and void. The traveler must be present at the place of travel as mentioned in the invoice, email, or message. If, for any reason, you are unable or unwilling to participate, please inform us as soon as possible to check for any alternative options. If you are unable to be present on time, you will be allowed a maximum of 30 minutes of waiting time, beyond which you may be considered absent and additional fees may be charged. In such cases, your entire booking may also be considered void, and you will not be eligible for any refund policies.
Travel-Related Documents
Any travel-related documents, identification papers, or receipts must be preserved at your responsibility and provided with accuracy. If any mistake is detected, it should be immediately reported. In case you lose any essential items, get stolen, or damage, you will be solely responsible for them.
Accidents and Incidents Notification
If, during the tour, any individual meets with an accident or passes away, the houseboat authorities will not be held responsible. The concerned individual, their family member, or representative (who booked the tour) will be responsible and liable for any expenses or payments related to it.
Compensation
You also agree that if you or any representative of ours, any supplier, or any other party associated with us causes any form of property or reputation damage, you will bear the responsibility and provide compensation.
Ownership of Pictures/Photos & Videos
Batan Houseboat owns all rights to the images & Videos.
Prohibition of Illicit Goods, Narcotics, and Services
If you carry any form of illicit drugs or unlawful items or engage in any illegal activities, you will be solely responsible for them, and if such things lead to financial loss or damage to our reputation, you will be immediately liable for compensation.
Loss or Theft from Boats
We are not liable for any items lost or stolen from the boat due to your negligence during the travel period.
Other Terms and Conditions
Batan Houseboat reserves the right to retain this agreement, make any changes, or cancel the agreement without prior notice. Regular usage of our website and availing of our services implies that you accept and abide by the changes in this agreement. Any obligations or rights stated in this agreement are not transferable to any third party. We may terminate this agreement at any time.
This agreement will be governed by the laws of Bangladesh, and any provision of this agreement that is deemed unlawful or unenforceable will not have any effect on other provisions.”
